I.ELIGIBILITY OF PARTICIPANTS

1.1 Participants must be at least 18 years of age and US & Canada residents only, excluding Quebec, can travel from north America on the dates of the event.

1.2 The winner is required to follow local and/or USA travel requirements

1.3 It is the winner’s sole responsibility to ensure they have all of the required documentation for travelling to LA (e.g. valid passport, non-immigrant visa, etc.)

1.4 Employees of EPOS and their relatives are excluded from participation in the giveaway.

1.5 EPOS reserves the right, upon its sole discretion, to exclude participants on valid grounds, such as but not limited to:

• violation of the rules of the giveaway;
• manipulation of the technical process or administration of the giveaway;
• undue conduct; or
• false or misleading statements regarding participation in the giveaway.

II.NO PURCHASE NECESSARY

2.1 There are no requirements for the purchase of any goods or services offered by EPOS and/or any of its affiliates or business partners. Purchase of any such goods or services will not increase the participant’s chances in the giveaway.

III. PROCEDURE OF THE GIVEAWAY

3.1 To enter the giveaway the participants need to submit their information in the form at the following URLs:

3.2 One (1) eligible participant will be randomly selected as winners no later than the end of day of the giveaway of July 20th 2022. Winning participant will be contacted via email or phone within 48h following the end date of the giveaway.

3.3 Winners have 3 (three) days to reply to claim the prize giveaway. If the winners do not reply within 3 days, the winner's prize will be forfeited and may be awarded to another eligible participant.

IV. GIVEAWAY PERIOD

4.1 The giveaway will begin July 5, 2022 at 9:00 AM CET and will end on July 20, 2022 at 9:00 AM CET.

V. PRIZES

5.1There will be one (1) winner and a friend being awarded with flights from a major airport within North America, accommodation and $500 CAD travel stipend, access to the Call of Duty League 2022 Championship, Toronto Ultra Jersey, EPOS & Toronto Ultra merch pack, EPOS H6PRO & GSX 300 audio bundle and a ton of esports action.

5.2 All prizes must be accepted as awarded and may not be transferred, substituted or redeemed for cash or otherwise.

5.3 Prizes are offered "as is" with no written, express, or implied warranty.

VI. DATA PRIVACY

6.1 EPOS will be collecting personal data about participants, in accordance with its privacy notice. The information you provide will only be used for the purpose of the Giveaway unless you also provided consent to receive EPOS marketing communications. By participating in the Giveaway, each participant hereby agrees to EPOS’s collection and usage of his/her personal information for the purpose of the Giveaway as set out herein and acknowledges that he/she has read and accepted EPOS’ privacy notice.

6.2 Notwithstanding the above, each winner agrees that, by participating in the giveaway, EPOS may use the winner’s name in any manner and in any medium for its promotional purposes without additional approval or compensation being required, including posting in a winner’s list or on LinkedIn or Facebook/Instagram/Twitter.

VII. LIMITATION OF LIABILITY

7.1 To the extent permitted by law, EPOS is not responsible for:

• Any incorrect or inaccurate information associated with or utilized in the giveaway;
• technical failures of any kind including, but not limited to malfunctions, interruptions or disconnections in phone-lines or network, hardware or software;
• unauthorized human intervention in any part of the giveaway;
• technical or human error which may occur in the administration of the giveaway, or
• any injury or damage to persons or property which may be caused directly or indirectly, in whole or in part from participants participation in the giveaway.

7.2 EPOS is responsible for prize availability, but not for prize utility or quality or otherwise.

7.3 The reporting and payment of any taxes on prizes, if necessary, are the sole responsibility of the winner.

VIII. REVOCATION, TERMINATION AND WITHDRAWAL

8.1 Participants may withdraw from the giveaway at any time. Within reasonable time upon notification, EPOS will delete all data collected from the participant. Participants may declare their withdrawal at any time to EPOS at privacy@demant.com.

8.2 Revocation of the right to use participant’s personal data is possible at any time. However, such revocation will necessarily be followed by the exclusion of the participant from the giveaway.

8.3 EPOS reserves the right to cancel or end the giveaway at any time, without notice or reason.

IX. APPLICABLE LAW AND JURISDICTION

9.1 The Giveaway is governed by and construed in accordance with Danish law, excluding its conflict of law rules. Any disputes arising under the Giveaway will be settled by the Danish courts.

X. MISCELLEANOUS

10.1 The invalidity or unenforceability of any provision of these terms and conditions will not affect the validity or enforceability of any other provision. In the event that any provision of the terms and conditions is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

10.2 EPOS’ failure to enforce any term of these terms and conditions will not constitute a waiver of that provision.
